1) Scope & Definitions

1.1 Scope. This Refund & Dispute Policy (“Policy”) applies to all purchases of and subscriptions to the Addrify App and related services provided by Addrify BrandWorks LLC (“Addrify,” “we,” “us,” or “our”), including but not limited to: visitor intelligence, address resolution, contact discovery, CRM/webhook integrations, outbound SMS/email campaigns, AI Call services, booking/calendar features, and any add‑ons, usage‑based metered features, or credit packs (collectively, the “Services”).

1.2 B2B Focus. Addrify provides Services to businesses only (B2B). Our Services are not intended for personal/household consumer use.

1.3 Key Terms.

  • Subscription: Recurring paid access to the Services for a defined term (monthly/annual).
  • Order: An online checkout, order form, or in‑app plan selection specifying features, term, quantity, and price.
  • Usage‑based Fees: Variable charges tied to consumption (e.g., SMS sends, minutes for AI Calls, webhook throughput, contact lookups).
  • Credits: Prepaid units for usage (e.g., SMS, call minutes).

2) General Refund Position

2.1 No Refunds by Default. Except as expressly stated in this Policy or required by law, all fees are non‑refundable and non‑cancellable once charged, including: subscription fees, setup/implementation fees, add‑ons, usage‑based fees, overages, and third‑party pass‑through costs.

2.2 Intangible & Variable Outcomes. Addrify delivers data‑driven, network‑ and source‑dependent Services. Lead availability, match rates, geocoding accuracy, and engagement outcomes vary by region, audience, and time. Variability in results is not a basis for refund.

2.3 Processor Fees. If a refund is approved, it is processed to the original payment method less any non‑recoverable processor / network fees (e.g., card fees retained by acquirers or Stripe). Refund timing depends on your bank/processor.

2.4 Taxes. Collected taxes are non‑refundable unless required by applicable law.


3) Trials, Proofs of Concept & Promotions

3.1 Trials/POCs. If your Order explicitly includes a free trial or proof of concept, you may cancel before the trial ends to avoid being charged. Charges incurred during or after the trial are non‑refundable.

3.2 Promotions. Discounts, coupons, promotional credits, or service credits have no cash value and are not refundable or transferable.


4) Subscription Terms, Renewals & Proration

4.1 Auto‑Renewal. Subscriptions renew automatically for successive periods unless cancelled in accordance with the Cancellation Policy (to be read together with this Policy).

4.2 Mid‑Term Downgrades. Plan downgrades take effect at the next renewal; no proration or refund for the remaining term unless we state otherwise in writing.

4.3 Upgrades. Upgrades and add‑ons are charged immediately and are non‑refundable.


5) Usage‑Based Fees, Credits & Third‑Party Costs

5.1 Usage Fees. Fees for SMS, AI Calls, email sends, contact lookups, webhooks and other metered features are charged based on consumption. These fees are non‑refundable once the usage occurs or the credits are provisioned.

5.2 Credits. Purchased credit packs (e.g., SMS, call minutes) are non‑refundable, may expire as stated at purchase, and cannot be exchanged for cash.

5.3 Third‑Party Dependencies. You may need third‑party accounts (e.g., Twilio, Mailchimp) to use certain features. You are responsible for those accounts and any charges, compliance obligations, or limitations imposed by those providers. Addrify is not liable for third‑party outages, filtering, deliverability, policy enforcement, or blocks, and such events do not entitle you to a refund.


6) Service Availability, SLA & Credits

6.1 Uptime. We aim for high availability but may experience maintenance windows, provider outages, upstream data source changes, or network incidents.

6.2 Service Credits (Not Cash Refunds). If we publish an SLA and a verified outage materially below the SLA occurs, we may offer service credits applied to future invoices. Service credits are at our discretion, have no cash value, and do not constitute refunds.


7) Data Legality, Consent & Acceptable Use (Refund‑Related)

7.1 Lawful Basis & Consent. You represent and warrant that you have all necessary rights, consents, and lawful bases to use Addrify, including for address resolution, contact discovery, messaging, and calling. Violations of law or policy by you are not refundable.

7.2 Compliance. You are solely responsible for compliance with applicable laws (e.g., TCPA/Do‑Not‑Call, CAN‑SPAM, state privacy laws like CCPA/CPRA, VCDPA, CPA, CTDPA, UCPA, and any other jurisdictional rules). Non‑compliant campaigns, blocked traffic, spam complaints, or enforcement actions do not warrant refunds.

7.3 Prohibited Uses. Stalking, harassment, discrimination, or any unlawful profiling or targeting is strictly prohibited. Any breach voids refund eligibility and may result in suspension or termination.


8) Dispute Process with Addrify (Prior to Chargeback)

8.1 Start with Support. Before initiating a processor/bank chargeback, contact us first at hello@addrify.com with:

  • Business name, email, and billing contact
  • Order ID / invoice number, charge date/amount, and last 4 digits of the card
  • Description of the issue (with logs, screenshots, dates, and impacted features)

8.2 Time Limits. Submit disputes within 30 days of the charge date. Beyond that window, we may be unable to assist.

8.3 Investigation. We will review your request and respond within 10 business days with our findings and any proposed resolution (e.g., configuration fix, reprocessing, limited service credit).

8.4 Evidence. You agree to cooperate and furnish reasonable evidence (e.g., campaign IDs, message IDs, call logs, webhook IDs) to facilitate resolution. Failure to provide evidence may result in denial.


9) Chargebacks & Payment Disputes (Card/Bank)

9.1 Contact Us First. Filing a chargeback without first attempting resolution with us may delay or reduce your prospects for a favorable outcome.

9.2 Our Response. We contest unfounded disputes and provide processors with evidence of authorization, usage, and delivery.

9.3 Suspension. We may suspend Services if you initiate a chargeback until the dispute is resolved. If a chargeback is resolved in our favor, your account must be brought current (including any chargeback fees) before Service restoration.

9.4 Administrative Fees. You may be responsible for chargeback and retrieval fees imposed by payment processors. These are non‑refundable.


10) When We May Issue a Refund (Narrow Exceptions)

Subject to our verification and discretion, we may consider a partial or full refund where:

  • Duplicate charge occurred due to a technical error and you promptly notified us (within 30 days).
  • A clearly documented billing error (e.g., incorrect plan rate vs. Order) occurred on our side.
  • A material misconfiguration attributable to us prevented any use of the core Service for more than 7 consecutive days and we could not provide a workaround or service credit.

Note: Poor campaign performance, low match rates, deliverability blocks, end‑user opt‑outs, or compliance‑based filtering do not qualify.


11) How to Request a Refund or Raise a Dispute

Email hello@addrify.com with the subject line “Refund/Dispute Request – [Your Business Name] – [Invoice/Order #]” and include:

  • Business name and contact details
  • Invoice/Order number and charge date/amount
  • Description of the issue and remedy sought
  • Supporting evidence (logs, IDs, screenshots, timestamps)

We will acknowledge receipt and guide next steps.


12) Currency, Timing & Method

  • Currency: All refunds (if any) are in USD.
  • Method: Refunds (if any) are issued to the original payment method only.
  • Timing: Bank processing times vary; allow 5–10 business days after approval.

13) Relationship to Other Policies & Priority

This Policy complements our Cancellation Policy, Refund Policy, Privacy Policy, and Terms of Service. In the event of conflict, Terms of Service control to the maximum extent permitted by law.


14) Changes to this Policy

We may update this Policy from time to time. Material changes will be posted on https://addrify.com/ with a new “Last updated” date. Continued use of the Services after publication constitutes acceptance.
